These General Terms and Conditions (“GTC”) apply to the use of the website www.maksupay.com (hereinafter referred to as the “Website“) as well as to all business relationships initiated via this Website between Maksu GmbH (hereinafter referred to as the “Media Owner“) and its users or contractual partners.

1.2. Unless expressly agreed otherwise in writing, the inclusion of the user’s or contractual partner’s own terms and conditions is explicitly rejected.

1.3. Unless expressly stated otherwise, the offers and information provided on this Website are directed exclusively at entrepreneurs as defined by § 1 para. 1 line 1 of the Austrian Consumer Protection Act (KSchG) (B2B).

6. Final Provisions (Jurisdiction and Governing Law)

6.1. All contracts and relationships between the Media Owner and the contractual partner shall be governed exclusively by Austrian law, to the exclusion of its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

6.2. If the contractual partner is an entrepreneur as defined by the Austrian Commercial Code (UGB), the exclusive place of jurisdiction for all disputes arising out of or in connection with this agreement shall be the court with local and material jurisdiction for the Commercial Court of Vienna – Handelsgericht Wien, Austria.

6.3. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions (Severability Clause).
